Este libro informativo, publicado en febrero de 2025, investiga el papel de la legislación sobre contratación pública en la regulación de la adquisición de sistemas de inteligencia artificial (IA) para su uso en la administración pública en los Estados miembros de la UE. Presenta análisis en profundidad de las organizaciones, procedimientos e instrumentos de contratación pública en Austria, Dinamarca, Francia, Alemania, Italia, España y el Reino Unido, así como comparaciones detalladas de sus respectivos marcos jurídicos.
AI systems are increasingly being used in public administration. The use of AI comes with both benefits and challenges, including issues of transparency, lack of control, and biased decision-making. The regulation of AI has therefore been made a priority in the EU, with the AI Act being the world’s first specific, cross-sector AI regulation. What has often been overlooked in the legal discussion on AI, however, is the fact that public procurement law is a key instrument to enable contracting authorities to ensure that procurement objects comply with all legal and practical requirements for their use in public administration. Against this background, there is an urgent need for research to determine whether and to what extent Member States’ procurement legislation and practice are designed or capable of implementing the requirements for the use of AI in public administration in the procurement process.
